Privacy Policy

Last Updated: May 12, 2026

Next Day Fences (“Next Day Fences,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy (the “Policy”) explains how we collect, use, disclose, and safeguard information when you visit https://www.nextdayfences.com (the “Site”), request a quote, call or message us, or otherwise interact with our services. By using the Site or contacting us, you acknowledge and agree to the practices described below; if you do not agree, please do not use the Site or submit information to us. We may update this Policy from time to time, and continued use of the Site after changes are posted means you accept the revised version, so please review this page periodically.

1. Information We Collect

Information You Provide Directly

We collect information you provide directly through quote requests, forms, calls, emails, on-site visits, or newsletter sign-ups, including your name, phone number, email, mailing and property addresses, project details (fence type, materials, dimensions, layout, timing, budget), photos or documents about your property, payment information for transactions, and anything else you choose to share.

Information Collected Automatically

We also automatically collect technical information when you visit the Site, including IP address, approximate location, device identifiers, browser type, operating system, referring and exit pages, pages viewed, links clicked, time on page, and date/time of access.

Information from Third Parties

We may receive additional information about you from third-party services we use, including our online quote provider (My Salesman / myfence.mysalesman.com), advertising platforms, review sites, and referral partners.

2. Cookies and Tracking Technologies

Our Site uses cookies, pixels, tags, and similar tracking technologies, including those delivered through Google Tag Manager, to operate the Site, remember your preferences, analyze traffic, and support our advertising. Cookies may be session-based (deleted when you close your browser) or persistent (until they expire or you delete them). You can control or block cookies through your browser settings, though doing so may affect how the Site functions.

Our Site does not currently respond to “Do Not Track” browser signals, as no industry standard has been finalized. We will update this section if that changes.

3. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries, prepare estimates, and conduct on-site assessments
  • Install, repair, replace, and service fences and gates
  • Process payments, manage accounts, and handle warranty claims
  • Send appointment reminders, project updates, invoices, and receipts
  • Pull permits, schedule utility locates, and coordinate with subcontractors
  • Send newsletters, promotions, and marketing communications where permitted
  • Improve our Site, services, and customer experience
  • Detect and prevent fraud or unauthorized activity
  • Comply with legal obligations and enforce our terms

We retain personal information only as long as reasonably necessary for these purposes, to comply with legal and tax obligations, to resolve disputes, and to support warranty service. Project and warranty records may be kept for the duration of the warranty period and beyond as required by law.

4. How We Share Your Information

We do not sell your personal information. We may share information with:

  • Service providers that help operate our business — our quote/CRM platform (My Salesman), payment processors, web hosting, email and SMS providers, analytics and call-tracking vendors, and marketing partners — all authorized to use your information only for services performed on our behalf.
  • Subcontractors and trade partners that assist with permits, utility locates, material delivery, or installation labor.
  • Legal and safety purposes — to comply with subpoenas, court orders, or other legal process; enforce our agreements; protect rights, property, or safety; or investigate fraud.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets.
  • Aggregated or de-identified data — non-identifying data may be shared with partners, advertisers, or for analytics.

We do not share SMS opt-in information (phone numbers and consent records) with third parties for their own marketing purposes. Mobile information may be shared with subcontractors only to support the services you requested.

5. Phone Calls, Text Messages, and TCPA Consent

By providing your phone number to Next Day Fences, through our Site, by phone, in person, or otherwise, you expressly consent to receive communications from us and our authorized representatives, including:

  • Telephone calls (live or pre-recorded)
  • SMS or MMS text messages
  • Calls or texts placed using an automated dialing system, where permitted by law

These communications may relate to estimates, scheduling, project updates, warranty service, payment matters, customer service, and occasional marketing or promotions. Consent is not a condition of purchase. Standard message and data rates may apply. Message frequency varies based on your project status.

To opt out of text messages, reply STOP to any text from us. To opt back in, reply START. For help, reply HELP. After opting out, you may still receive transactional messages directly related to an active project. Calls may be monitored or recorded for quality assurance, training, and recordkeeping in accordance with Minnesota’s one-party consent law and other applicable laws.

If you sign up for our newsletter or marketing emails, you can unsubscribe at any time via the unsubscribe link in any email or by contacting us directly. Transactional and service-related messages (such as appointment confirmations and invoices) will continue as needed to fulfill your project.

6. Third-Party Analytics and Advertising

We may use third-party services such as Google Analytics, Google Tag Manager, Google Ads, Facebook/Meta, and other advertising or analytics platforms to understand how visitors interact with our Site and to deliver advertising. These services may use cookies and similar technologies to collect information about your activity on the Site and other websites over time. We may also use conversion tracking and remarketing/retargeting tools, which means you may see ads from Next Day Fences on other sites after visiting ours.

You can opt out of certain interest-based advertising through:

Opting out does not stop all advertising; you will still see ads, but they may be less relevant to you.

7. Links to Other Websites

Our Site may link to third-party websites, including our online quote tool, social media (such as YouTube), review platforms, and partner sites. We are not responsible for the privacy practices or content of these sites. Please review their privacy policies before sharing any information with them.

8. Your Privacy Rights and Choices

You may, at any time:

  • Ask what personal information we have about you
  • Request corrections or updates to inaccurate information
  • Request deletion of your personal information, subject to legal and contractual retention requirements
  • Opt out of marketing emails or text messages
  • Withdraw consent for future communications

To exercise any of these rights, please contact us using the information in Section 13. We will respond within a reasonable timeframe and in accordance with applicable law. We do not discriminate against you for exercising your privacy rights.

If you are a resident of a state with specific privacy laws — including California, Colorado, Connecticut, Delaware, Minnesota, New Jersey, Oregon, Texas, Utah, Virginia, or others — you may have additional rights, such as the right to access, correct, delete, or limit the use of your personal information. Contact us to learn more about how these apply to you.

9. Data Security

We use commercially reasonable physical, electronic, and procedural safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You share information with us at your own risk. If you create an account with us, keep your credentials confidential and notify us immediately if you suspect unauthorized use.

10. Children’s Privacy

Our Site and services are intended for adults. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us, and we will take reasonable steps to delete it.

11. Changes to This Policy

We may update this Policy to reflect changes in our practices, technology, legal requirements, or operations. Updates will be posted on this page with a revised “Last Updated” date, and material changes will be communicated through the Site or by email where appropriate. Continued use of the Site after an update constitutes acceptance of the revised Policy.

12. Governing Law

This Policy is governed by the laws of the State of Minnesota, United States, without regard to its conflict of laws principles. Disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota.
